Gift Card Terms and Conditions

 

  1. Redemption and Use

Borla Digital Gift Cards (“Gift Cards”) can only be redeemed on the Borla Performance Industries, Inc. (“Borla”) website at www.borla.com, for the purchase of products listed on the website. Gift Cards cannot be used in any third-party locations or websites. Gift Cards are non-refundable and cannot be exchanged for cash, except as required by law. Once a Gift Card is purchased and delivered, no refunds or exchanges will be allowed.

  1. Transferability

Gift Cards are non-transferable and can only be used by the recipient to whom the card was issued.  It is the purchaser’s responsibility to ensure that the intended recipient’s email address is correct. The recipient must use the same email address, where they received the Gift Card, for the order(s) in which they redeem the Gift Card.

  1. Expiration, Fees and Balance

Gift Cards do not expire and do not incur any fees for use or inactivity, unless permitted by law. Customers can check the balance of their Gift Card by logging into their account or by contacting Customer Service at [email protected], or 1-877-GO-BORLA.

  1. Lost or Stolen Cards

Borla is not responsible for lost, stolen or unauthorized use of Gift Cards. Once the Gift Card is sent to the recipient’s email, the risk of loss passes to the customer and recipient of the Gift Card.

  1. Fraud Prevention

Borla reserves the right to refuse or cancel any Gift Card, without refund or other compensation, if we suspect fraud, unauthorized use or violations of our terms of service. Any attempt to defraud our Gift Card program may result in the cancellation of the card and prosecution to the fullest extent of the law.

  1. Restrictions and Limitations

Gift Cards can only be purchased and redeemed from within the United States. If a purchase is made that exceeds the remaining balance on a Gift Card, the excess must be paid for using a USA Credit Card only. Gift Cards cannot be used to purchase other Gift Cards. Only one Gift Card can be used per transaction, unless otherwise specified. Gift Cards cannot be used in conjunction with other Promotions or Special Offers, unless specified.

  1. Limited Liability

Borla is not liable for any technical issues, such as delays in delivery of Gift Cards or any interruptions in service that might prevent the card from being used.

  1. Governing Law

These Terms and Conditions are governed by the laws of the State of Tennessee, without regard for its conflict of laws rules.  Any disputes related to Gift Cards must be brought exclusively in the courts of Washington County, Tennessee, or in the federal district court for the Eastern District of Tennessee, Greeneville Division.  To the fullest extent permitted by law, the purchaser or user of a Gift Card irrevocably waives any right he or she may have to a trial by jury in any dispute related to Gift Cards. 

  1. Changes to Terms and Conditions

Borla reserves the right to change these terms and conditions at any time, without prior notice. Terms and Conditions will be maintained and posted on our website. Terms and conditions in effect when a Gift Card is used or when any dispute arises, if earlier, shall apply to the use of such Gift Card, regardless of when the Gift Card was purchased.
